Financing is routinely greater than the original purchase price of a home (after including interest and closing costs). Because financing is so important, buyers should have as much information as possible regarding mortgage options and costs.</p>

Loans with 5 percent down or less are available — in fact, loans from major lenders with no money down have appeared in recent years. If you place less than 20 percent down, lenders will want the mortgage guaranteed by an outside third party such as the Veterans Administration (VA), the Federal Housing Administration (FHA) or a private mortgage insurer (PMI, or private mortgage insurance, is required by lender to protect against any mortgage defaults).</p>

The closing process, which in different parts of the country is also known as “settlement” or “escrow,” is increasingly computerized and automated. In many cases, buyers and sellers don’t need to attend a specific event; signed paperwork can be sent to the closing agent via overnight delivery.</p>
<p style="margin: 0px 0px 25px; padding: 0px; font-size: 12px; color: #333333; line-height: 18px;">Settlement is a brief process where all of the necessary paperwork needed to complete the transaction is signed. Title to the property is transferred from seller to buyer. The buyer receives the keys and the seller receives payment for the home. From the amount credited to the seller, the closing agent subtracts money to pay off the existing mortgage and other transaction costs. Deeds, loan papers, and other documents are prepared, signed and filed with local property record offices.</p>
<p style="margin: 0px 0px 25px; padding: 0px; font-size: 12px; color: #333333; line-height: 18px;">Before closing, buyers typically have a final opportunity to walk through the property to assure that its condition has not materially changed since the sale agreement was signed. At closing itself, all papers have been prepared by closing agents, title companies, lenders and lawyers. This paperwork reflects the sale agreement and allows all parties to the transaction to verify their interests. For instance, buyers get the title to the property, lenders have their loans recorded in the public records and state governments collect their transfer taxes.</p>
<p style="margin: 0px 0px 25px; padding: 0px; font-size: 12px; color: #333333; line-height: 18px;"><strong>Resolution #10: Tie Up Loose Ends</strong><br />
You’ve done it. You’ve looked at properties, made an offer, obtained financing and gone to closing. What’s next?</p>
<p style="margin: 0px 0px 25px; padding: 0px; font-size: 12px; color: #333333; line-height: 18px;">Those papers you received at settlement are extremely valuable, so hold on to them! In the short-term they can help establish tax deductions for the year in which the property was purchased. In the future, such papers will be important for tax purposes when the property is sold, and in some cases, for calculating estate taxes.</p>
<p style="margin: 0px 0px 25px; padding: 0px; font-size: 12px; color: #333333; line-height: 18px;">Also at closing, determine the status of the utilities required by the home, items such as water, sewage, gas, electric and oil service. You want utility bills to be paid in full by owners as of closing and you also want services transferred to your name for billing. Usually such transfers can be done without turning off utilities. About two weeks after closing, contact your local property records office and confirm that your deed has been officially recorded. Such records are public notices that show your interest in the property.</p>
<p style="margin: 0px 0px 25px; padding: 0px; font-size: 12px; color: #333333; line-height: 18px;">When you move in, you may want to replace all locks just to be safe. Many owners make a photo or video record of the home and their possessions for insurance purposes and then keep the records in a safety deposit box. Your insurance provider can recommend what to photograph and how to secure it. You want to maintain fire, theft and liability insurance. As the value of your property increases such coverage should also rise.</p>

<h2><strong><span>Confirm the <a href="http://santaclaritahomes.com">current market value</a> of your <a href="http://santaclaritahomes.com">home</a>.<br />
</span></strong></h2>
<p>This first step in the process is having a Comparative Market Analysis (CMA) or Broker Price Opinion (BPO) completed for your home.  What you believe is the <a href="http://santaclaritahomes.com">current market value</a> may or may not be accurate.  As a <a href="http://santaclaritahomes.com">licensed realtor</a>, I have the training and resources to complete this valuation of your home.  The CMA will show prices of similar homes that are active on the market, pending sales, and <a href="http://santaclaritahomes.com">homes that have sold</a> during the past six months.</p>
<h2><strong><span>Sign a <a href="http://santaclaritahomes.com">Listing Agreement</a>.</span></strong></h2>
<p>I will prepare a Listing Agreement that will reflect an appropriate listing price upon which we have agreed.  Special language will be included in the MLS that indicates your home is a short sale and that lender approval is required.  I will then <a href="http://santaclaritahomes.com">market your home</a> and get it sold.</p>
<h2><strong><span>Sign an Authorization Form.</span></strong></h2>
<p>Lenders will require that you give them permission to disclose information about your loan to others such as your realtor, a title company, or attorney.  You will need to sign an Authorization Form to give permission for me to talk with your lender.  Your lender may or may not have a specific form for this purpose.</p>
<h2><strong><span>Contact your lender.</span></strong></h2>
<p>Your lender will need to be contacted to inform them that you wish to pursue a <a href="http://santaclaritahomes.com">short sale</a> of your home.  Lenders have “loss mitigation” departments that handle this process.  The lender may or may not have a specific short sale application but will have a list of required documents that must be submitted in order to consider a short sale.</p>
<h2><strong><span>Write a Hardship Letter.</span></strong></h2>
<p>You must write a letter to your lender as soon as possible that describes your financial situation and why you need the short sale.  The letter should be factual and it is best if it is limited to one page in length.  You should describe how this financial bind occurred and it should reflect your request that the lender accept less than full payment.  You must prove to the lender that you are a victim of a hardship and unable to continue making mortgage payments.</p>
<h2><strong><span>Assemble the Needed Documents.</span></strong></h2>
<p>A number of documents will need to be submitted to your lender and it is important that the documents be assembled as quickly as possible.  This includes your tax returns for the last two years; last two months of bank statements, pay check stubs, and bank statements; and financial statement to include all income, assets, and expenses.</p>

<h2> <strong><span>Negotiate and <a href="http://santaclaritahomes.com">Accept a Purchase Agreement.</a></span></strong></h2>
<p>I will find a <a href="http://santaclaritahomes.com">buyer</a> who makes an offer to <a href="http://santaclaritahomes.com">purchase your home</a> at a price less than the amount of your mortgage.  I will assist you in evaluating the terms and conditions of the Purchase Agreement.</p>
<h2><strong><span>Submit the <a href="http://santaclaritahomes.com">Short Sale Package</a> to the Lender.</span></strong></h2>
<p>Once you have accepted a Purchase Agreement, I will assist you in ensuring that all needed information is submitted to the lender in a short sale package.  In addition to any short sale application form the lender may require, this will include copies of your financial documents, hardship letter, Listing Agreement, Purchase Agreement, and other documents the lender may require.</p>
<h2><strong><span>Negotiate the <a href="http://santaclaritahomes.com">Short Sale</a> with the Lender.</span></strong></h2>
<p>The lender will evaluate and verify the information submitted in the <a href="http://santaclaritahomes.com">short sale package.</a>  The lender will determine a value for the property and compare this to the amount due on the mortgage and the offer from the purchaser. I will contact your lender to discuss and negotiate the terms and conditions upon which the lender will approve a <a href="http://santaclaritahomes.com">short sale</a> of the property.  Usually there are back and forth discussions and negotiations with the lender.  I will assist you in evaluating the terms and conditions offered by the lender.</p>
<h2> <strong><span>Close</span></strong></h2>
<p>The final step is closing escrow for the sale of your property based upon the terms and conditions offered by the lender and approved by you.</p>

<p>If you are receiving my month foreclosure report you are noticing the overall “available” homes for sale decreasing combined with the number of closed sales decreasing.</p>
<p>This is a common trend we see year after year during the Holiday months.   However, there are many factors which will make 2012/20130 worth analyzing, especially before making any conclusions.  How many &#8220;active&#8221; listing are available on the market?  Of the active listing, which one’s are Standard sales, Short Sales or Bank owned homes?  What is the buying public doing right now??  Are they paying full price, above full price on their bids?  Are they making offers below the asking price?</p>
<p>If you follow my charts below you we see a trend.  One important indicator which suggest prices are going up will be found under the &#8220;Above or at List Price&#8221;.   Here is how the calculation is completed.   Take the total number of properties sold under the “list or above list price” column and divide it by the &#8220;total Closed&#8221; column.   Example:     172 DIVIDED BY 252 =68%.</p>
<p>As I predicted last month, this number would increase.  What this means to you and I, is basically prices will increase into 2013.  Earlier this year when sales where sluggish, we saw 4 out a 10 properties selling at list or above list price.   This is one indicator (out of many) which is used to determine where prices are heading.  Long story short, the number of standing homes for sale is at a 20 year low and the percentage of properties selling at full price or more are increase.  This will be the most aggressive 4<sup>th</sup> quarter we will see in a long time to come.</p>
